DMCA & Takedown Policy

This policy describes how MacYou handles copyright infringement claims under the Digital Millennium Copyright Act (DMCA) and the EU Digital Services Act (DSA).

1. Overview

MacYou is a hosting infrastructure provider that offers dedicated Apple Mac Mini M4 Pro cloud servers. As a hosting provider, MacYou does not control or monitor the content that customers store on or transmit through their servers. However, we are committed to complying with applicable copyright laws, including the United States Digital Millennium Copyright Act (17 U.S.C. § 512) and the EU Digital Services Act (Regulation (EU) 2022/2065).

MacYou respects the intellectual property rights of others and expects our customers to do the same. We will respond promptly to valid notifications of alleged copyright infringement and will take appropriate action, including removing or disabling access to material that is claimed to be infringing.

2. Filing a DMCA Notice

If you believe that material hosted on MacYou infrastructure infringes your copyright, you may submit a DMCA takedown notice. To be valid under 17 U.S.C. § 512(c), your notice must include all of the following:

  • Physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • Identification of the copyrighted work claimed to have been infringed. If multiple works are involved, provide a representative list.
  • Identification of the infringing material and information reasonably sufficient to permit MacYou to locate it, including the URL(s) or IP address(es) where the material is hosted.
  • Your contact information, including your name, mailing address, telephone number, and email address.
  • A good faith statement that you believe the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  • A statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.

Notices that do not substantially comply with these requirements may not receive a response. Knowingly submitting a materially false DMCA notice may expose you to liability under 17 U.S.C. § 512(f).

3. Where to Send Notices

We aim to acknowledge receipt of valid DMCA notices within 2 business days and to take action (remove or disable access) within 5 business days of receipt.

4. Counter-Notification

If you are a MacYou customer and believe that material removed or disabled on your server was removed in error or is not infringing, you may submit a counter-notification. Your counter-notification must include:

  • Your physical or electronic signature.
  • Identification of the material that was removed or disabled and the location where it appeared before removal.
  • A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which MacYou may be found), and that you will accept service of process from the person who filed the original DMCA notice.

Upon receiving a valid counter-notification, MacYou will forward it to the original complainant. If the complainant does not file a court action within 10 business days, MacYou will restore the removed material within 14 business days of receiving the counter-notification.

5. Repeat Infringer Policy

In accordance with the DMCA, MacYou maintains a policy for the termination of accounts belonging to repeat infringers. A customer will be considered a “repeat infringer” if MacYou receives more than two valid DMCA notices relating to material on their server(s) within any 12-month period, and no successful counter-notification has been filed.

Repeat infringers' accounts will be terminated, and no refund will be issued for any remaining prepaid service. MacYou reserves the right to terminate accounts after a single notice in cases of egregious or willful infringement.

6. EU Digital Services Act

MacYou is committed to compliance with the EU Digital Services Act (DSA), Regulation (EU) 2022/2065, as applicable to hosting service providers.

Transparency

MacYou publishes annual transparency reports detailing the number of takedown notices received, actions taken, and any use of automated detection tools. These reports are made available on our website.

Illegal Content Reporting

Individuals and entities within the EU may report illegal content hosted on MacYou infrastructure by emailing [email protected] with a detailed description of the content, the URL(s) or IP address(es) where it is located, and the legal basis for the illegality claim. MacYou will process such reports in accordance with DSA timelines and requirements.

7. Limitation of Liability

MacYou acts as a hosting provider and does not proactively monitor content stored on customer servers. To the maximum extent permitted by law, MacYou shall not be liable for content hosted by its customers. Our liability is limited to taking reasonable action upon receiving valid takedown notices as described in this policy.

MacYou will not be liable for any damages arising from the removal or disabling of access to material pursuant to a valid DMCA notice, nor for restoring material following a valid counter-notification, provided we act in good faith and in accordance with applicable law.

8. Changes to This Policy

MacYou may update this policy from time to time. When we make material changes, we will notify affected customers by email and/or by posting a notice on the platform at least 14 days before the changes take effect.
