Terms of Service

Please read these Terms of Service carefully before using the MacYou platform. By creating an account or using our services, you agree to be bound by these terms.
1. Acceptance of Terms
These Terms of Service (“Terms”) govern your access to and use of the services provided by MacYou (“MacYou,” “we,” “us,” or “our”), operating at macyou.co. MacYou is operated by Macyou LLC, a limited liability company registered in Georgia (entity ID 445839503).
By accessing or using MacYou, you confirm that you are at least 18 years of age, have the legal authority to enter into this agreement, and agree to comply with and be bound by these Terms. If you are using MacYou on behalf of a company or other legal entity, you represent that you have the authority to bind that entity.
If you do not agree to these Terms, you may not access or use the MacYou platform.
2. Description of Service
MacYou provides a cloud infrastructure platform that offers dedicated Apple Mac Mini servers on a rental basis. Our service includes:
- Bare-Metal servers — dedicated physical Mac Mini hardware provisioned exclusively for your use, with no shared tenancy.
- Virtual Machines (VMs) — virtualized macOS or other supported OS environments running on Mac Mini hardware.
- Infrastructure tooling — a web dashboard, REST API, and CLI for provisioning, configuring, and managing your servers.
- Network services — uplink connectivity, configurable firewalls, optional VPN add-ons, and dedicated IP addresses.
- Support — technical support via email at [email protected].
We reserve the right to modify, suspend, or discontinue any aspect of the service at any time, with reasonable advance notice where practicable.
3. Account Registration & Security
To use MacYou you must register for an account. You agree to:
- Provide accurate, complete, and current registration information.
- Maintain the security of your account credentials and not share them with any third party.
- Notify us immediately at [email protected] if you suspect unauthorized access to your account.
- Take responsibility for all activity that occurs under your account, whether or not authorized by you.
- Not create accounts by automated means or under false pretenses.
MacYou will never ask for your account password by email or phone. We strongly recommend enabling two-factor authentication where available.
4. Acceptable Use
Your use of MacYou is subject to our Acceptable Use Policy (AUP), which is incorporated into these Terms by reference. The AUP defines prohibited activities — including cryptocurrency mining, DDoS attacks, malware hosting, spam, and other abuses — as well as enforcement procedures and appeal rights.
MacYou reserves the right to investigate suspected AUP violations and to immediately suspend or terminate accounts engaged in prohibited activities, without prior notice where necessary to protect the platform or third parties. Violations may be reported at [email protected] or via our online abuse form.
5. Payment Terms
Plans and Pricing
MacYou offers tiered subscription plans with both monthly and annual billing. Current plan names, hardware specifications, prices, and active-deployment limits are published on our pricing page, which is the single authoritative source of pricing information.
Prices may change from time to time. Where a change affects an active subscription, MacYou will provide at least 14 days' advance notice by email to the address on file before the new price takes effect at the next renewal. Continued use of the service after the new price takes effect constitutes acceptance of the updated pricing.
Payment Methods & Processing
MacYou currently accepts payment in cryptocurrency (USDT on the TRON / TRC-20 network) on an invoice-per-period basis. We may add card or other payment methods in the future, in which case the options available will be shown at checkout. Where payments are processed by a third-party payment partner, that partner may be responsible for collecting and remitting applicable taxes (including VAT/GST) in supported jurisdictions; for payments made directly to MacYou (including cryptocurrency), Macyou LLC is responsible for its applicable tax obligations under the laws of Georgia.
Cryptocurrency Payments
If you pay in cryptocurrency, the following additional terms apply:
- Finality. Cryptocurrency transactions are irreversible. Once a payment is confirmed on the blockchain it cannot be reversed, recalled, or charged back. Any refund due under our Refund Policy is issued manually to the originating wallet address.
- Amount & network fees. You are responsible for sending the full invoiced amount in the specified asset and on the specified network. Network (gas) fees, exchange-rate fluctuations, and any shortfall caused by sending the wrong asset, the wrong network, or an insufficient amount are your responsibility; an underpaid invoice is treated as unpaid until the balance is settled.
- Compliance. You represent that any funds used are lawfully obtained and are not the proceeds of crime. MacYou applies anti-money-laundering and sanctions screening to payments (see our AML & KYC Policy) and may delay, refuse, or refund a payment, or suspend an account, where a transaction or wallet is flagged.
Recurring Billing & Auto-Renewal
Subscriptions are billed on a recurring basis (monthly or annually, depending on your chosen plan). Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. For invoice-based payments (including cryptocurrency), we issue an invoice for each upcoming period and your access continues only while each period's invoice is paid on or before its due date. Where you have provided a card or other chargeable payment method, you authorize MacYou (via our payment processor) to charge it on a recurring basis.
Failed Payments
If a payment fails, we will attempt to notify you and may retry the charge. Continued failure to pay may result in suspension or termination of your account and loss of access to your server(s).
Non-Payment, Suspension & Deletion
Subscriptions are paid in advance for each billing period. If a period is not paid by its due date, your access to the affected server(s) may be suspended (a reversible network and access lockout) shortly after the period lapses. If the outstanding amount is not settled within a short grace period (a few days, as indicated by the countdown in your dashboard), MacYou may permanently terminate the affected deployment(s) and securely and irreversibly erase all data on them (in accordance with NIST 800-88), returning the hardware to the available pool. Restoring access before deletion requires full payment of the amount due. No refund or credit is owed for service lost to non-payment, and you are solely responsible for maintaining your own backups; MacYou is not liable for any data lost as a result of suspension or deletion following non-payment. For cryptocurrency payments, you are responsible for ensuring funds are sent and confirmed on-chain before the due date — network confirmation delays do not extend these timelines.
6. Refund Policy
Our refund policy is described in detail on our dedicated Refund Policy page. Please review that page before making a purchase. In general, MacYou offers limited refunds at its discretion; dedicated hardware provisioned on your behalf is a significant operational commitment.
7. Service Level
MacYou targets a 99.9% monthly uptime for the underlying infrastructure and network connectivity. This target excludes:
- Scheduled maintenance windows, for which we will provide advance notice where possible (typically via the status page at macyou.co/status and/or email).
- Outages caused by circumstances outside our reasonable control, including force majeure events, upstream internet provider issues, or actions by third parties.
- Issues arising from your own configuration, software, or actions.
The uptime target is a goal, not a legally binding service level agreement (SLA) with financial penalties, unless a separate SLA agreement has been executed in writing between you and MacYou. We will publish incident reports and post-mortems for significant outages on our status page.
8. Data & Privacy
Your use of MacYou is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand how we collect, use, and protect your personal data.
You retain ownership of all data you store on or transmit through your MacYou server. MacYou will not access your server data except as necessary to provide technical support (with your consent), to comply with a legal obligation, or to investigate a suspected breach of these Terms.
Upon termination of your account, your server data will be securely wiped in accordance with NIST 800-88 guidelines. You are responsible for maintaining backups of any data you wish to retain.
9. Intellectual Property
All intellectual property rights in the MacYou platform, website, dashboard, API, and associated documentation are owned by MacYou or its licensors. Nothing in these Terms grants you any right, title, or interest in our intellectual property other than the limited right to use the service as described herein.
“Apple,” “Mac,” “Mac Mini,” and “macOS” are trademarks of Apple Inc. MacYou is an independent service provider and is not affiliated with, endorsed by, or sponsored by Apple Inc.
Apple Hardware Rental & macOS Licensing
MacYou rents you dedicated physical Apple hardware (bare-metal Mac Mini computers) located in our data center. MacYou does not sell, sublicense, or grant you any license to macOS or any other Apple software. macOS is licensed to you directly by Apple under the Apple macOS Software License Agreement (SLA) that accompanies the operating system, and your use of macOS is governed by that agreement.
By provisioning or accessing a Mac, you acknowledge and agree that you:
- accept and will comply with the Apple macOS SLA, which is presented to you on first login to the operating system;
- will use macOS only for purposes permitted by Apple for leased and hosted Mac hardware — including software development, testing, continuous integration and delivery (CI/CD), application building, and other uses expressly allowed under the Apple macOS SLA;
- will not use the service in any manner that violates the Apple macOS SLA or any other applicable Apple license terms; and
- are solely responsible for, and will indemnify MacYou against (see Section 11), any claim arising from your breach of the Apple macOS SLA or your misuse of Apple software.
You grant MacYou a non-exclusive, royalty-free license to use your logo and company name solely for the purpose of identifying you as a customer (e.g., on a customer list or case study), unless you opt out by contacting us at [email protected].
10. Limitation of Liability
To the maximum extent permitted by applicable law, MacYou and its directors, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, business interruption, or loss of goodwill, arising out of or in connection with your use of or inability to use the service.
In no event shall MacYou's total aggregate liability to you for all claims arising under or related to these Terms or the service exceed the total amount you paid to MacYou in the three (3) months immediately preceding the event giving rise to the claim.
The service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
11. Indemnification
You agree to defend, indemnify, and hold harmless MacYou, Macyou LLC, and their respective directors, officers, employees, agents, suppliers, and partners from and against any and all claims, demands, actions, investigations, liabilities, damages, losses, fines, penalties, costs, and expenses (including reasonable attorneys' fees and the costs of responding to subpoenas or legal process) arising out of or related to:
- your use of, or activities conducted through, the service;
- any content, data, software, or material you store, transmit, deploy, or process on or through your server(s);
- your violation of these Terms, the Acceptable Use Policy, or any applicable law or regulation;
- your infringement or misappropriation of any intellectual property, privacy, publicity, or other right of any third party, including any claim brought by a copyright holder or by Apple Inc.; and
- any claim by a third party arising from your acts or omissions.
MacYou reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims. You agree not to settle any matter that imposes any obligation or liability on MacYou without MacYou's prior written consent. This obligation survives the termination of your account and these Terms.
12. Termination
Cancellation by You
You may cancel your subscription at any time through the account dashboard or by contacting support. Upon cancellation, your subscription will remain active until the end of the current billing period, after which access to your server(s) will be terminated and data wiped. No partial refunds are issued for unused time within a billing period unless otherwise stated in our Refund Policy.
Termination by MacYou
MacYou may suspend or terminate your account immediately and without prior notice if you:
- Violate any provision of these Terms;
- Engage in conduct that MacYou reasonably determines is harmful to other customers, third parties, or MacYou's infrastructure;
- Fail to pay any amounts due; or
- Are subject to a legal order or government direction requiring termination.
MacYou may also terminate accounts with 30 days' written notice for any reason, in which case we will provide a pro-rata refund for any prepaid but unused service.
Upon termination for cause, no refund will be issued and any outstanding balances remain due.
13. Sanctions & Export Control
MacYou services are not available to residents of, or persons located in, countries subject to comprehensive sanctions by the United States (OFAC), the European Union, the United Kingdom (HM Treasury OFSI), or the United Nations. This currently includes, but is not limited to: Cuba, Iran, North Korea, Syria, and the Crimea, Donetsk, and Luhansk regions of Ukraine. We additionally apply the EU and UK sectoral sanctions packages adopted against Russia and Belarus from February 2022 onward, and we screen for designated Russian and Belarusian entities and individuals on those lists.
By using MacYou, you represent and warrant that you are not (a) located in a comprehensively sanctioned country or territory, (b) listed on any applicable sanctions or restricted-party list (including the OFAC SDN list, the EU Consolidated List, the UK HM Treasury Consolidated List, and the sectoral-sanctions lists referenced above), or (c) owned or controlled, directly or indirectly, by such a person or entity.
MacYou reserves the right to terminate accounts without refund where we have reasonable grounds to believe this section has been violated. You are solely responsible for ensuring your use of the service complies with all applicable export control laws and regulations, including the U.S. Export Administration Regulations (EAR) and the EU Dual-Use Regulation.
14. Chargeback Policy
If you have a billing concern, we strongly encourage you to contact [email protected] before initiating a chargeback with your bank or card issuer. We resolve the vast majority of billing issues within 48 hours.
Cryptocurrency payments are irreversible and are not subject to chargebacks; any billing concern relating to a crypto payment is handled exclusively through our support and refund process.
Filing a fraudulent chargeback — i.e., disputing a legitimate charge for services that were delivered as described — may result in immediate termination of your account, forfeiture of any remaining service period, and referral to a debt collection agency for the disputed amount plus any chargeback fees incurred by MacYou.
MacYou will provide transaction records and evidence to your payment provider in response to any chargeback dispute.
15. Automatic Renewal
All MacYou subscriptions (monthly and annual) automatically renew at the end of each billing period at the then-current rate, unless you cancel before the renewal date. By subscribing, you authorize MacYou (via our payment processor) to charge your payment method on a recurring basis.
You may cancel your subscription at any time from Dashboard → Billing → Cancel subscription. Cancellation takes effect at the end of the current billing period. See our Refund Policy for details on refund eligibility.
16. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Georgia (the country), without regard to its conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Georgia.
If you are a consumer located in a jurisdiction whose laws provide additional or different protections, those protections may also apply to you.
17. Electronic Signatures
By clicking “I agree,” checking a terms acceptance checkbox, or otherwise indicating acceptance on the MacYou platform, you agree that such action constitutes your electronic signature and is legally binding, equivalent to a handwritten signature, under the U.S. Electronic Signatures in Global and National Commerce Act (ESIGN), the EU eIDAS Regulation, and any applicable local e-signature laws.
We log all terms acceptance events (including timestamp, IP address, user agent, and the specific document version accepted) to maintain an auditable record.
18. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email (at the address associated with your account) and/or by posting a prominent notice on the platform, no less than 14 days before the changes take effect.
Your continued use of MacYou after the effective date of any updated Terms constitutes your acceptance of the revised Terms. If you do not agree with the changes, you must stop using the service and cancel your subscription before the changes take effect.
